Thought

If the torture we're discussing ever came to a trial, I don't think you could impanel a jury of 12 and get a unanimous guilty verdict against anyone.

  • It won't come to trial. I think there's an attempt by the Obama administration to put the values or ideas of Cheney/Bush in the "court of public opinion." But I don't think they want the political distraction of an actual legal proceeding. I don't think they even want Congress to hold any official investigations.

  • I would prefer to see an open Congressional investigation to the more private proceedings of a special prosecutor or court trials.

    Part of me despairs of ever 'fixing' this problem. If something as basic as habeas corpus can be summarily dismissed, as if it never existed, as the Bush bunch did...

  • My opinion, the flaw wasn't as much in the law as the people who let themselves be manipulated through fear into giving up the Constitution.

    AND, a pet peeve. George Bush always said he swore to protect the people of the US.

    The inauguration oath all PResident's utter (Obama twice) does not pledge to protect the people or the country, but to protect and defend the Constitution.

    The Constitution is given special place above the peoples and borders.
