Torture is proven in a US court, but Rumsfeld skates

(BBC) A US court has dismissed a lawsuit against former US defence secretary Donald Rumsfeld over claims prisoners were tortured in Iraq and Afghanistan.

The court accepted that the nine men who sued had been tortured - and detailed the torture in its ruling. .....

The nine men suffered abuse including being:

  • hung upside-down and slapped until they lost consciousness
  • stabbed with knives
  • subjected to electric shocks
  • deprived of sleep by loud noises and bright lights
  • grabbed by aggressive dogs
  • They also were subjected to sexual humiliation.
None was ever charged with a crime. All were released after detentions of one month to one year.

  • Is this the Pinochet defense? You can't sue government official at this level when they are acting in their official capacity?

    I wonder if Rummy ever has a lay-over in Europe if he'll be detained as a war criminal. No. I don't really think so, but I'd guess that it would be legal under international law.

  • How are war crimes treated in the International criminal court? (or the bilateral equivalent agreements the US has forced around the world.)

    As I understand it, if your country tries you, you can't be charged elsewhere. However, that requires a fair trial and hearing of the evidence, and since Rumsfeld was immunized by his office, I don't think that would count.

    Plus, we're talking war crime/torture confirmed by the US judge.

    So, I would guess he could face jeopardy if any country was willing to take the wrath of the US.

    By the way, it's not talked about much, but there are many countries where Kissinger won't travel.
